PLEASE READ THIS DOCUMENT CAREFULLY. IT CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS. IT ALSO CONTAINS A DISPUTE RESOLUTION CLAUSE.

Welcome to vouchercloud. We are glad you have chosen to use our application. We are committed to providing the best possible value and convenience for you. Before you get started, you must read and agree to these Terms of Service. Thank you.

Acceptance of Terms of Service

By downloading and using vouchercloud ("vouchercloud," "we" or "us"), you accept and agree to be bound by these Terms of Service. vouchercloud may at any time modify these Terms of Service. You can review the most current version of it by clicking on the "Terms of Service" link located at the bottom of the vouchercloud website, voucher-cloud.ie. The most current version will supersede all previous versions. By continuing to use the vouchercloud application after changes are made and notified to you (on the mobile number you have registered with us), you agree to be bound by such changes.

Privacy Policy

vouchercloud values your privacy and is dedicated to safeguarding and preserving your privacy when using our application, visiting our website or communicating electronically with us.

This Privacy Policy, together with our Terms & Conditions explains what happens to the types of personal and non-personal information we collect when you use the vouchercloud application and website (vouchercloud). By using vouchercloud you agree to the terms of this Privacy Policy. If you do not agree to these terms please do not continue using vouchercloud.

vouchercloud uses the personal information we collect to provide our service to you. We will not rent, sell or share your personal information with any other company for its own marketing purposes without your consent except where mentioned within this policy.

Collection of Information

In order to deliver you the best possible service when using vouchercloud, we collect and process the following information:

Information you provide us

When you download vouchercloud and use a voucher for the first time, we ask you to register and provide us with personal information as follows: Your name, email address, date of birth, postcode and gender.

There are also opportunities within vouchercloud to provide the email addresses or contact details of your friends or family members and your social networking site login details to allow you to tell people about vouchercloud. We may use the information you provide us along with your voucher usage details, to provide you with a better experience when using vouchercloud. We will always provide you the opportunity to opt out of receiving any communication via email.

When you use or connect to vouchercloud's website or download the vouchercloud mobile app by or through a Third Party Platform, such as Facebook or other social networking site, you allow us to access and/or collect certain information from your Third Party Platform profile/account (such as your Facebook account) or via any cookies placed on your device by such Third Party Platform as permitted by the terms of the agreement and your privacy settings with the Third Party Platform. We will share such information with the Third Party Platform for their use as permitted by the terms of the agreement and your privacy setting with the Third Party Platform.

We will share some of the information we collect from you upon install of the mobile app with vendors and other service providers who are engaged by or working with us in connection with the operation of the services we provide to you and/or for analytics purposes which may require the reproduction and display of such information in an aggregated and anonymized manner such that will not in any way identify you.

You may "opt out" of the collection of your information for third party analytics purposes by following the directions provided by our third party analytics vendor located at http://www.mobileapptracking.com/privacy-policy/. If you "opt out" with our third party analytics provider, that action is specific to the information we collect specifically for that provider, and does not limit our ability to collect information from you, under the terms of this privacy policy, for other vendors.

Usage and redemption information

As part of the standard operation of using vouchercloud, we may collect certain non-personal information from you. For example, when you redeem a voucher, your mobile phone automatically records and sends basic information about your voucher redemption and application browsing. This may include the dates and times and redemption information and in the case of an offer being rejected, the information relating to the reason behind the rejection. We may combine this non-personal information with your personal information.

Mobile phone location

When you use vouchercloud, we may receive your location and will use this to give you offers which are near you. Depending on your handset or the network you subscribe to, vouchercloud may automatically receive this information.

Mobile UDID

When you use the vouchercloud application for the first time, we will receive a unique identifier for your phone if your handset manufacturer or network provide it. vouchercloud may use your unique mobile device identification information to offer you extended services and/or functionality. We may associate that information to the mobile device identification information and to other information we have collected from and about you; however we will not use that number to telemarket to you.

Directly communicating with vouchercloud

When you send email or other communication to vouchercloud, we may retain the communication in order to serve you.

Information you provide on our Partners' websites

You might find links to third party websites on our website. These websites should have their own privacy policies which you should check. We do not accept any responsibility or liability for their policies whatsoever as we have no control over them.

Merchant Loyalty Information

vouchercloud may collect and save various merchants' Loyalty Card numbers for you. These numbers may be stored on the vouchercloud servers and will be transmitted between the vouchercloud servers and your device.

Use of Information and Data

All personal data is stored securely in accordance with the Data Protection Act 1988 to 2003 and the e Privacy regulations S.I 336 OF 2011.

Unless we are legally required to do so, your data will not be disclosed to third parties.

Where applicable, we may disclose your personal information to any member of our group. This includes, where applicable, our affiliates, our subsidiaries, our holding company and / or other companies within our group.

Unsubscribe

Users who wish to no longer receive one of our promotional emails may click on the "Update your preferences" or “Unsubscribe� link which is embedded with every email sent by vouchercloud to opt out of individual types of promotional email.

Use of Cookies

We may on occasion gather information regarding your computer whilst you are on our website. This enables us to improve our services and to provide statistical information regarding the use of our website to our advertisers where appropriate.

Such information will not identify you personally it is statistical data about our visitors and their use of our site. This statistical data does not identify any personal details whatsoever.

Similarly to the above, we may gather information about your general internet use by using a cookie file. Where used, these cookies are downloaded to your computer automatically. This cookie file is stored on the hard drive of your computer as cookies contain information that is transferred to your computer's hard drive. They help us to improve our website and the service that we provide to you.

All computers have the ability to decline cookies. This can be done by activating the setting on your browser which enables you to decline the cookies. Please note that should you choose to decline cookies, you may be unable to access particular parts of our website.

Our advertisers may also use cookies, over which we have no control. Such cookies (if used) would be downloaded once you click on advertisements on our website.

We have take certain operational, physical and technical steps available to safeguard and secure the information we collect from our users and store on our servers.

Changes to this Policy

vouchercloud reserves the right to change or modify this privacy Policy. If we change this Privacy Policy, you will be notified of any changes and be asked to approve again our policy.

Access To Information

The Data Protection Act, 1988 to 2003 and the e privacy regulations S.I 336 OF 2011 gives you the right to access the information that we hold about you. Please note that any demand for access may be subject to payment of a fee of €10 which covers our costs in providing you with the information requested. Limitations on Use

You must be at least eighteen years old to download and use the vouchercloud application, or, if you are not at least eighteen, you may download and/or use the vouchercloud application only in conjunction with, and under the supervision of, your parent or guardian. If you do not qualify, please do not download the vouchercloud application.

Intellectual Property

vouchercloud and/or its licensors are the sole owners of the vouchercloud application, which includes any software, domains, and content made available through it. The vouchercloud application is protected by Eurpoean, UK and International copyright and other intellectual property laws. It is for your own personal and non-commercial use only, and vouchercloud grants you a limited license for that purpose. Without limitation, this means that you may not sell, export, license, modify, copy, reverse engineer, distribute or transmit the vouchercloud application without vouchercloud's prior express written permission. Any unauthorized use of the vouchercloud application will terminate the limited license granted by us. vouchercloud and its graphics, logos, icons and service names related to the vouchercloud application are registered and unregistered trademarks or trade dress of Invitation Digital Ltd. They may not be used without vouchercloud's prior express written permission. All other trademarks not owned by vouchercloud that appear in connection with the vouchercloud application are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by vouchercloud.

Electronic Communications

By downloading and/or using the vouchercloud application, you consent to receiving electronic communications and notices from vouchercloud. Invitation Digital (the publisher of vouchercloud) may also send you electronic communications and notices promoting their own similar services. We will send you information about our voucher codes, printable vouchers, deals, sales of other products, loyalty schemes and services we feel may interest you. You agree that any notice, agreement, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

Your Conduct

By downloading and using the vouchercloud application, you agree not to upload, post, e-mail or otherwise send or transmit any material that contains viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the vouchercloud application. You also agree not to interfere with the servers or networks connected to the vouchercloud application or to violate any of the procedures, policies or regulations of networks connected to the vouchercloud application, the terms of which are incorporated herein. You also agree not to: (1) impersonate any other person while using the vouchercloud application; (2) conduct yourself in a vulgar, offensive, harassing or objectionable manner while using the vouchercloud application; (3) use the vouchercloud application for any unlawful purpose; or (4) resell or export the software associated with the vouchercloud application.

vouchercloud does not promote, recommend or condone use of the vouchercloud application during certain activities, such as automobile driving, where there is a significant risk of accident. You agree not to use the vouchercloud application during such activities.

Third Party Offers

The vouchercloud application may contain links to third party web sites or programs that are not controlled by or affiliated with vouchercloud. vouchercloud is not responsible for the content, offers or privacy policies of such sites and programs, including, without limitation, your redemption of such offers or a merchant's refusal to honour any offer. Your dealings with third party sites are solely between you and the applicable third party.

Charges for Using the vouchercloud application

vouchercloud currently provides the vouchercloud application to you free of charge. However, when you use the vouchercloud application, you may be subject to charges imposed by your wireless or other applicable carrier. Payment of such charges is solely your responsibility. The vouchercloud application may not be accessible in some foreign countries, this will depend on the vouchercloud application being supported by the foreign network. You should check with the local carrier whether you will be required to pay additional charges for such access. The ability to download or access the vouchercloud application may be restricted or impaired when on a roaming network abroad

Use of Information Submitted

You agree that vouchercloud is free to use any comments, information or ideas contained in any communication you may send to vouchercloud without compensation, acknowledgement or payment to you for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the vouchercloud application or other products or services.

No Warranty & Liability Limit

vouchercloud provides the vouchercloud application "as is" and without any warranty or condition, whether express, implied or statutory. vouchercloud specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement. vouchercloud assumes no liability or responsibility for any errors or omissions in the vouchercloud application; any failures, delays or interruptions in the vouchercloud application; any losses or damages arising from the use of the vouchercloud application, including, without limitation, any damage to your mobile device; or any conduct by users of the vouchercloud application. We reserve the right to deliver the vouchercloud application in our sole and absolute discretion.

In no event shall vouchercloud, its shareholders, directors, officers, employees or agents be liable (jointly or severally) to you for loss of use or any special, incidental, indirect or consequential damages arising out of or in connection with the vouchercloud application or these terms of service, on any theory of liability, and whether or not advised of the possibility of damage. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

Indemnity

You agree to indemnify and hold vouchercloud and its related companies, and each of their respective shareholders, directors, officers, employees, agents and merchant partners harmless from and against any third-party claim or cause of action, including reasonable attorneys' fees and court costs, arising, directly or indirectly, out of your use of the vouchercloud application or your violation of any law or the rights of any third party.

Disputes

Governing Law

You agree that these terms of service or any claim, dispute or controversy (whether in contract, tort or otherwise, whether preexisting, present or future, and including statutory, common law and equitable claims) between you and vouchercloud arising from or relating to these Terms of Service, their interpretation or breach, termination or validity, the relationships which result from these Terms of Service, the vouchercloud application, vouchercloud's advertising or any related transaction shall be governed by and contrued in accordance with the laws of the Irish Republic.

General

If any provision of these Terms of Service is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the extent or scope of such section. Our failure to enforce any provision of these Terms of Service shall not constitute a waiver of that or any other provision. These Terms of Service set forth the entire understanding and agreement between you and vouchercloud with respect to the subject matter hereof.
